Terms of Service Agreement For Mail-In and In-Shop Repairs

General Release

Customer requests services from GADGET DROP REPAIR LLC, its agents, distributors, affiliates or licensees [Repair Center] to repair a suspected faulty electronic device and understands that the Repair Center is not liable or responsible for any problems or damages arising from the diagnostic, repair, or attempted repair of the electronic device.

Customer understands and agrees the electronic device is currently in a defective state and that this repair is an attempt to restore usable functionality via repair. Customer understands this is a risky repair and that many things can render the device unusable and releases the Repair Center from all responsibility for success or failure.

30-Day Limited Warranty

Repair Center warrants its repairs and replacement parts for 30 days from the date that the Repair Center deems the specific repair completed. This limited warranty is only good for the specific repair performed. This limited warranty is not assignable by the Customer. The Customer understands the warranty does NOT cover defects caused by his or herself or someone other than the Repair Center.

Remedies

If the device malfunctions during the 30 days outlined above, the customer must, at his or her own cost, return the device to the repair center within the 30 days of such repair. The exclusive remedy provided in this Agreement is the repair or the refund of the amount that the Repair Center charged for such repair minus the fee for diagnosing and reassembly.

Water/Liquid Damage Repairs

Customer understands that even though his or her electronic device might be in “operational condition” or in “partial operational condition” the electronic device may cease to work after diagnostic and attempted repair because water/liquid damage can cause loss of data and memory, corrosion, rust, electrical shortage, and device failure, thus the Repair Center is not liable for any problems arising from diagnostic, repair or attempted repair. Additionally, the Customer understand and agrees the 30 day limited warranty outline above does not cover any device that previously suffered from water/liquid damage.

Flashing and Unlocking Services

Customer understands and agrees that if Customer’s device has any type of issue or problem after being flashed/unlocked, Repair Center will not be liable or responsible for any such problems or damages. Additionally, Customer must pay for all types of flash and unlocking services performed, regardless of the outcome.

Data/Memory Loss

The Customer understands and agrees that the Repair Center may need to wipe, delete, clear, and master reset a particular device which can result in data, software, and memory loss. The Customer understands and agrees that the Repair Center is not liable for any damages caused by such wipe, delete, clear, or master rest.

Repair Time

The Repair Center will make a reasonable attempt to repair Customer's electronic device within the estimated time frame communicated to the Customer; however, Customer understands and agrees that the repair can take longer than originally estimated. The Repair Center is not liable for any damages caused by such delays. The Repair Center in its sole discretion may refrain from providing the repair service and refund, either partially or fully, the amount the Customer paid for the repair service.

Device That is Not Repairable

The Repair Center at its sole discretion will decide if the device is repairable or not. The Customer agrees to pay diagnostic and reassembly fee if the device is deemed not repairable by the Repair Center.

Customer understands Repair Center will work hard to fulfill and complete the requested repair successfully. The Customer also understands a successful repair outcome is not always possible, therefore, the Customer releases the Repair Center from any liability arising from Repair Center attempt to perform any repairs.

Abandoned Device

Customer understands and agrees that any device left for over 30 days from the date the Customer is notified to pick it up will be parted out and/or recycled by the Repair Center. Customer agrees that the Repair Center will not be liable for any damages for any device that is left for over 30 days from the date the Customer is notified to pick it up.

Software & Data

Customer guarantees that he or she is the sole owner of the content and software or has the appropriate licenses and authorizations to the content and software contained on the device to be repaired. Customer guarantees that he or she has the legal authority to grant Repair Center the ability to back up the data, copy the data, transfer the data, and install software. Customer grants Repair Center the ability to act on Customer's behalf to back up the data, transfer the data, copy the data, and install software. Customer agrees and understands that he or she is solely responsible for any infringements of intellectual property rights, trade secrets rights, and all other rights and obligations.

Manufacturer Warranty

Repair Center is not responsible if its repair causes the manufacturer's warranty to be void. Additionally, Customer understands and agrees that Repair Center may in its sole discretion choose to use either third party parts or original manufacture parts in servicing the Customer's device.

Severability

If any provision of this Agreement will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so limited.
